National Audiovisual Council Decision No 286 of 14 April 2011 On the publication of codes of professional conduct adopted by audiovisual media service providers Issuer: the National Audiovisual Council Published in: The Official Gazette No 297 of 29 April 2011

Having regard to the dual role of the National Audiovisual Council, the guarantor of the public interest and single regulatory authority in the field of audiovisual media services,

In view of the Audiovisual National Council of the Audiovisual Law No 504/2002, with subsequent amendments and additions, on encouraging co-regulation and self-regulation in the audiovisual field,

Taking into account the role that self-regulation can play as a complement to the legislative mechanisms established in the field of audiovisual media services,

In view of the specific nature of audiovisual media services, especially the impact of these services on the way people form their opinions, and, in this respect, the importance of public access to the editorial recognized and adopted by the person responsible for the content of these services,

Taking into account the requirements of Directive 2010/13/EU of the European Parliament and of the Council of 10 March 2010 on the coordination of certain provisions laid down by law, regulation or administrative action in Member States concerning the provision of audiovisual media services (Audiovisual Media Services Directive),

Given that editorial independence, freedom of expression and protection against censorship are guaranteed by the Constitution of Romania, as republished, and Act No 504/2002, as amended,

In order to safeguard editorial independence of suppliers of audiovisual media services, recognised and guaranteed by law, and to avoid any interference in the content, form or procedure for the presentation of audiovisual media services, from public authorities or any natural or legal person, Romanian or foreign,

Having regard to the obligation on Member States of the European Union to ensure that the public is given, at any time, easy and direct access to a minimum set of information on the audiovisual media service provider,

Pursuant to Articles 6 (5), 10 (3) (j), 17 (1) (d) and Article 48 of Law No 504/2002, with subsequent amendments and supplements,

The National Audiovisual Council has adopted the following decision:

Art. 1 By 1 October 2011, each provider of audiovisual media services will publish on its own website, its code of professional conduct. Art. 2 Within 30 days after the publication of this Decision in the Official Gazette of Romania, Part I, audiovisual media service providers must permanently display on the home page of their website, in conspicuous place: A) the detailed, clear and updated information referred to in Article 48 of the Audiovisual Law No 504/2002, with subsequent amendments and supplements; B) the postal address and the website of the National Audiovisual Council.
